Darwin says, "This is really not funny, some good samaritans were threatened and the man was likely trying to stay low from the law for a reason, and acting to protect himself."

Dec. 11, 2007, 12:34AM Man clinging to Good Samaritans' car falls off, dies. He grew upset when a witness called 911 at site of an earlier accident

By ERIC HANSON Copyright 2007 Houston Chronicle

A motorist was killed in an unusual accident in Conroe after he fell from a car he was holding onto and was hit by another vehicle.

The accident happened about 7:40 p.m. Sunday on FM 1314 near Ave. M, said Conroe police Sgt. Bob Berry.

Berry said the man, David Garcia Hernandez, 20, a Honduran, was killed after threatening two people who had stopped to help him when he had been involved in a minor accident.

"It is kind of bizarre," Berry said.

Berry said the incident started when Hernandez drove a Ford pickup off the southbound pavement and into a ditch, where it became stuck in mud. A man and a woman who were passing by stopped to offer help.

"We call them the Good Samaritans," Berry said. "They allowed him to use their cell phone."

Berry said another motorist stopped by and told Hernandez and the other two people that 911 had been called and police were on the way.

"Hernandez became agitated and began to threaten the Good Samaritans. He tried to get inside their vehicle," Berry said.

The pair told police Hernandez threatened to kill them and also said he wanted to get away from the accident scene.

Berry said the couple, who were in a Dodge Charger, were frightened and drove away.

But Hernandez managed to cling to the door and with a cigarette he was smoking he burned the man on the arm.

"As the Good Samaritans drove off. He was still on the vehicle. The next block down the victim (Hernandez) either fell off or dropped off," Berry said.

Hernandez landed on the road and was hit by a motorist driving a minivan. He was taken to Conroe Regional Medical Center, where he died.

Berry said investigators do not know why Hernandez suddenly became agitated at the notion of police arriving on the scene.

No warrants had been issued for his arrest.

"Maybe he did not have a driver's license. He was a Honduran national," Berry said. "We don't know his status as far as being in the country."

Police are not releasing the names of the other motorists.

This guy not only held onto the car as it drove away but he attacked the driver of the car by burning him with a cigarette? Even though he ultimately died as a result of being hit by another car his behavior sure qualifies for a Darwin as far as I'm concerned. Even if he hadn't been hit by that other car, hanging onto a moving car and attacking the driver isn't exactly the smartest thing to be doing. Thanks for sending this in, Rick!
